INFORMATIVA SUL TRATTAMENTO DEI DATI PERSONALI

ai sensi dell’art. 13 del Regolamento (UE) 2016/679 (GDPR)

La presente informativa è resa ai sensi dell’art. 13 del Regolamento (UE) 2016/679 (di seguito “GDPR”) agli utenti che consultano e utilizzano il sito web https://poradaua.it/ del Congresso Nazionale delle associazioni ucraine in Italia APS (di seguito, il “Sito”).

1. Titolare del trattamento

Il Titolare del trattamento è Congresso Nazionale delle associazioni ucraine in Italia APS con sede legale in Sede legale: Viale Degli Innamorati, 441 cap 81034 Mondragone (CE) Italia C.F. 95027110618, contattabile all’indirizzo e-mail congresso.uait@gmail.com   

2. Tipologia di dati trattati

I dati personali oggetto di trattamento sono a titolo esemplificativo:

• Indirizzo IP dell’utente;
• indirizzo e-mail;
• eventuali ulteriori dati personali contenuti nel messaggio inviato dall’utente.

Il Titolare invita gli utenti a non inserire dati personali non necessari o dati appartenenti a categorie particolari ai sensi dell’art. 9 o 10 GDPR.

3. Finalità del trattamento

I dati personali forniti tramite il form di contatto saranno trattati per le seguenti finalità:

• rispondere alle richieste di informazioni, contatto o assistenza inviate dall’utente;
• gestire le comunicazioni con l’utente conseguenti alla richiesta effettuata.
• Adempiere a tutti gli obblighi di legge connessi alle comunicazioni con il cliente

4. Base giuridica del trattamento

La base giuridica del trattamento è l’esecuzione di misure precontrattuali adottate su richiesta dell’interessato ai sensi dell’art. 6, par. 1, lett. b) GDPR, nonché il legittimo interesse del Titolare a dare riscontro alle richieste pervenute (art. 6, par. 1, lett. f) GDPR) e, se previsto, per adempiere ad eventuali  obblighi legale al quale è soggetto il titolare del trattamento (art. 6, par. 1, lett. c) GDPR).

5. Modalità del trattamento

Il trattamento dei dati personali è effettuato mediante strumenti informatici e/o telematici, con logiche strettamente correlate alle finalità indicate e nel rispetto dei principi di liceità, correttezza, trasparenza e minimizzazione dei dati.
Sono adottate adeguate misure di sicurezza tecniche e organizzative per prevenire accessi non autorizzati, perdita o uso illecito dei dati.

6. Conferimento dei dati

Il conferimento dei dati personali è facoltativo e a discrezione dell’utente; tuttavia, il mancato conferimento dei dati indicati come necessari comporterà l’impossibilità per il Titolare di rispondere alla richiesta inviata dall’utente.

7. Conservazione dei dati

I dati personali saranno conservati per il tempo strettamente necessario a gestire e dare riscontro alla richiesta dell’utente e, successivamente, per il periodo eventualmente necessario ad adempiere a obblighi di legge o a tutelare i diritti del Titolare.

8. Comunicazione e diffusione dei dati

I dati personali non saranno diffusi.
Essi potranno essere comunicati a soggetti esterni che agiscono in qualità di responsabili del trattamento ai sensi dell’art. 28 GDPR, debitamente nominati dal Titolare, esclusivamente per finalità connesse alla gestione tecnica del Sito o delle comunicazioni (es. fornitori di servizi IT).

9. Trasferimento dei dati extra UE

I dati personali non saranno trasferiti verso Paesi extra UE. Qualora ciò si rendesse necessario, il trasferimento avverrà nel rispetto delle garanzie previste dal GDPR.

10. Diritti dell’interessato

L’interessato può esercitare in qualsiasi momento i diritti previsti dagli artt. 15-22 GDPR, tra cui:

• diritto di accesso ai dati personali;
• diritto di rettifica o cancellazione;
• diritto di limitazione del trattamento;
• diritto di opposizione al trattamento;
• diritto alla portabilità dei dati, ove applicabile.

11. Diritto di reclamo

L’interessato ha il diritto di proporre reclamo all’Autorità Garante secondo le modalità previste dall’art 77 GDPR per la protezione dei dati personali, qualora ritenga che il trattamento dei propri dati avvenga in violazione della normativa vigente.

This privacy notice is provided pursuant to Article 13 of Regulation (EU) 2016/679 (hereinafter “GDPR”) to users who browse and use the website https://poradaua.it/ of the National Congress of Ukrainian Associations in Italy (hereinafter, the “Website”).

1. Data Controller

The Data Controller is National Congress of Ukrainian Associations APS, with registered office at Viale degli Innamorati, 441

2. Categories of personal data processed

The personal data processed may include, by way of example:

• User’s IP address;
  • e-mail address;
  • any additional personal data contained in the message sent by the user.

The Data Controller invites users not to provide unnecessary personal data or data belonging to special categories pursuant to Articles 9 or 10 of the GDPR.

3. Purposes of the processing

Personal data provided through the contact form will be processed for the following purposes:

• to respond to requests for information, contact or assistance submitted by the user;
• to manage communications with the user following the submitted request;
• to comply with all legal obligations related to communications with the client.

4. Legal basis for the processing

The legal basis for the processing is the performance of pre-contractual measures taken at the request of the data subject pursuant to Article 6(1)(b) GDPR, as well as the legitimate interest of the Data Controller in responding to received requests (Article 6(1)(f) GDPR) and, where applicable, compliance with a legal obligation to which the Data Controller is subject (Article 6(1)(c) GDPR).

5. Methods of processing

Personal data are processed using electronic and/or telematic tools, according to logic strictly related to the purposes indicated and in compliance with the principles of lawfulness, fairness, transparency and data minimisation.
Appropriate technical and organisational security measures are adopted to prevent unauthorised access, loss or unlawful use of the data.

6. Provision of data

The provision of personal data is optional and at the discretion of the user; however, failure to provide the data indicated as necessary will make it impossible for the Data Controller to respond to the user’s request.

7. Data retention

Personal data will be retained for the time strictly necessary to manage and respond to the user’s request and, thereafter, for the period required to comply with legal obligations or to protect the rights of the Data Controller.

8. Communication and disclosure of data

Personal data will not be disclosed.
They may be communicated to external subjects acting as data processors pursuant to Article 28 GDPR, duly appointed by the Data Controller, exclusively for purposes related to the technical management of the Website or communications (e.g. IT service providers).

9. Transfer of data outside the EU

Personal data will not be transferred to countries outside the European Union. Should such transfer become necessary, it will take place in compliance with the safeguards provided for by the GDPR.

10. Rights of the data subject

The data subject may exercise at any time the rights provided for by Articles 15–22 GDPR, including:

• the right of access to personal data;
• the right to rectification or erasure;
• the right to restriction of processing;
• the right to object to processing;
• the right to data portability, where applicable.

11. Right to lodge a complaint

The data subject has the right to lodge a complaint with the competent Supervisory Authority in accordance with Article 77 GDPR, should they consider that the processing of their personal data infringes the applicable legislation.

ПОВІДОМЛЕННЯ ПРО ОБРОБКУ ПЕРСОНАЛЬНИХ ДАНИХ

відповідно до статті 13 Регламенту (ЄС) 2016/679 (GDPR)

Це повідомлення надається відповідно до статті 13 Регламенту (ЄС) 2016/679 (далі – «GDPR») користувачам, які переглядають та використовують вебсайт https://poradaua.it/ асоціації  Національний Конгрес українських асоціацій Італії (далі – «Сайт»).

1. Володілець даних

2. Категорії персональних даних

Персональні дані, що обробляються, можуть включати, зокрема:

• IP-адреса користувача;
• адреса електронної пошти;
• будь-які інші персональні дані, що містяться у повідомленні, надісланому користувачем.

Володілець даних просить користувачів не надавати непотрібні персональні дані або дані, що належать до спеціальних категорій відповідно до статей 9 або 10 GDPR.

3. Мета обробки

Персональні дані, надані через контактну форму, обробляються з метою:

• надання відповідей на запити щодо інформації, зв’язку або допомоги, надіслані користувачем;
• управління подальшою комунікацією з користувачем у зв’язку з поданим запитом.
• Виконання всіх юридичних обов’язків, пов’язаних із комунікаціями з клієнтом

4. Правові підстави обробки

Правовою підставою обробки є виконання попередніх договірних заходів на запит суб’єкта даних відповідно до статті 6(1)(b) GDPR, а також законний інтерес Володільця даних щодо надання відповіді на отримані запити (стаття 6(1)(f) GDPR) та, у разі необхідності, виконання юридичного обов’язку, покладеного на Володільця даних (стаття 6(1)(c) GDPR).

5. Спосіб обробки

Обробка персональних даних здійснюється з використанням електронних та/або телематичних засобів, відповідно до логіки, тісно пов’язаної із зазначеними цілями, та з дотриманням принципів законності, добросовісності, прозорості та мінімізації даних.
Застосовуються належні технічні та організаційні заходи безпеки для запобігання несанкціонованому доступу, втраті або незаконному використанню даних.

6. Надання даних

Надання персональних даних є добровільним і здійснюється на розсуд користувача; однак ненадання даних, визначених як необхідні, унеможливить надання відповіді на запит користувача.

7. Строк зберігання даних

Персональні дані зберігаються протягом часу, необхідного для обробки та надання відповіді на запит користувача, а також надалі протягом періоду, необхідного для виконання вимог законодавства або захисту прав Володільця даних.

8. Передача та поширення даних

Персональні дані не підлягають поширенню.
Вони можуть передаватися зовнішнім суб’єктам, які діють як обробники даних відповідно до статті 28 GDPR та належним чином призначені Володільцем даних, виключно для цілей, пов’язаних із технічним управлінням Сайтом або комунікаціями (наприклад, постачальникам ІТ-послуг).

9. Передача даних за межі ЄС

Персональні дані не передаються до країн за межами Європейського Союзу. У разі необхідності така передача здійснюватиметься з дотриманням гарантій, передбачених GDPR.

10. Права суб’єкта даних

Суб’єкт даних має право у будь-який час скористатися правами, передбаченими статтями 15–22 GDPR, зокрема:

• правом на доступ до персональних даних;
• правом на виправлення або видалення даних;
• правом на обмеження обробки;
• правом на заперечення проти обробки;
• правом на перенесення даних, якщо це застосовно.

11. Право на подання скарги

Суб’єкт даних має право подати скаргу до компетентного наглядового органу відповідно до статті 77 GDPR, якщо він вважає, що обробка його персональних даних здійснюється з порушенням чинного законодавства.
